Emergency Services Disclaimer – Mehrmaa Healthcare Pvt. Ltd. Health Plan

  • (a) The Mehrmaa Healthcare Pvt. Ltd. Health Plan is strictly limited to preventive, promotive, and comprehensive health services, including but not limited to: routine check-ups, consultations with registered Practitioners, health monitoring, wellness advice, and health education.
  • (b) The Health Plan does not cover any emergency, critical care, urgent, or life-threatening medical services, including but not limited to: accident care, trauma, cardiac events, stroke, hospitalization, ICU services, or ambulance services.
  • (c) Users acknowledge and agree that in the event of an emergency or life-threatening condition, they must immediately contact the nearest emergency medical services or hospital. Mehrmaa Healthcare Pvt. Ltd. shall not be responsible for any medical outcomes, complications, or delays arising from reliance on the Health Plan for emergency care.
  • (d) The Health Plan is designed solely for preventive, promotive, and routine healthcare management, and any medical consultation or advice provided under this Plan is not a substitute for emergency medical attention.
  • (e) Users are solely responsible for seeking immediate medical care in emergency situations, and by using the Plan, they acknowledge that emergency coverage is not included in the Health Plan services.

(“Company,” “Mehrmaa,” “we,” “our,” or “us”), operating through our official website www.callyourdoctor.in, provides digital health services including but not limited to report checking, comprehensive health profiling, risk assessment, symptom analysis, dietary and lifestyle assessment, antenatal care (ANC), postnatal care (PNC), weight management programs, mother-and-child health guidance, and teleconsultation with licensed healthcare providers (collectively, the “Services”).

We are committed to maintaining the highest ethical and professional standards in safeguarding your personal data. This document contains two key sections:

  • Preparing and maintaining your Health Profile on the Basis of Reports (HPOTB).
  • Providing dietary assessments and health progress tracking.

  • Conducting teleconsultations with qualified doctors.
  • Improving platform performance and enhancing user experience.
  • Generating anonymized research insights and statistical analysis.
  • Meeting legal, regulatory, and compliance obligations.

4. Data Retention

  • Health and personal records will be retained for as long as required for providing Services and as mandated by law.
  • If you request deletion, records will be securely erased subject to statutory requirements.
  • Aggregated and anonymized data may be retained indefinitely for research and analytics.

5. Data Sharing and Disclosure

We will never sell or rent your information. Data is shared only in the following circumstances:

SECTION II – TERMS OF SERVICE

2. Eligibility

  • Users must be at least 18 years old.
  • For maternal and child health services, guardians may register and provide consent on behalf of minors.

3. Nature of Services

  • Services are preventive, advisory, and supportive in nature, focused on report checking, profiling, dietary advice, risk assessment, ANC/PNC guidance, weight management, and teleconsultation.
  • No emergency services are provided.
  • Teleconsultations are conducted by licensed practitioners but should not replace in-person examinations when clinically indicated.

4. User Responsibilities

You agree to:

  • Provide accurate, complete, and updated information.
  • Use the Services only for lawful purposes.
  • Maintain confidentiality of login credentials.
  • Abstain from misuse, unauthorized access, or distribution of platform content.

5. Payment and Billing

  • Paid Services must be settled through approved payment gateways.
  • Fees are non-refundable except in cases of technical failure.

6. Intellectual Property Rights

SECTION III – GENERAL PROVISIONS

  1. Entire Agreement: This document constitutes the complete agreement between the user and Mehrmaa Healthcare Pvt. Ltd.
  2. Waiver: Failure to enforce a provision shall not constitute waiver of rights.
  3. Assignment: User rights under this Agreement are non-transferable.

SECTION IV – ADDITIONAL TERMS OF USE FOR PRACTITIONERS

The terms in this Clause 4 apply exclusively to Practitioners (including doctors, nutritionists, wellness coaches, and any licensed healthcare professionals) who register, create a profile, or provide Services through Mehrmaa Healthcare Pvt. Ltd. (“Platform”).

4.1 Listing Policy

4.1.1 Mehrmaa Healthcare Pvt. Ltd, directly and indirectly, collects information regarding Practitioners’ profiles, qualifications, contact details, registration numbers, licenses, and practice information. Mehrmaa Healthcare Pvt. Ltd. reserves the right to display or take down any Practitioner’s profile, with or without prior notice, for reasons including but not limited to non-compliance, inaccuracy, or violation of applicable law.

4.1.2 Practitioners are responsible for the accuracy of information displayed on their profiles. If any information is incorrect, the Practitioner must notify Mehrmaa Healthcare Pvt. Ltd. immediately for correction.

4.1.3 Mehrmaa Healthcare Pvt. Ltd. is not liable for the ranking, visibility, or search engine results related to Practitioner profiles on external websites.

4.1.4 Mehrmaa Healthcare Pvt. Ltd. may moderate Practitioner-generated suggestions, feedback, or content and may remove any abusive, misleading, or promotional material. However, the Platform is not liable for the presence of inactive, fraudulent, or inaccurate profiles uploaded by third parties.

4.1.5 Practitioners explicitly agree that content shared on their profiles may be published, repurposed, or made available through third-party platforms strictly in accordance with applicable law.

4.1.6 If the Platform provides any telephony or call-back functionality for appointment purposes, such calls may be recorded for quality and support purposes. Practitioners hereby consent to such recordings, which will be handled per the Privacy Policy. Such services are for appointment scheduling only, not for clinical consultations.

4.1.7 Practitioners warrant that they shall use the Services in full compliance with applicable laws, medical council regulations, and ethical standards. Any contravention is solely the responsibility of the Practitioner.

4.2 Profile Ownership and Editing Rights

4.2.1 While Practitioners may update or edit their profiles, the final decision to approve, publish, or reject such updates lies with Mehrmaa Healthcare Pvt. Ltd.

4.2.2 All Practitioner profiles, photographs, and associated content hosted on the Platform are deemed intellectual property of Mehrmaa HealthcarePvt. Ltd. Practitioners grant a perpetual, royalty-free license for such use.

4.2.3 Practitioners represent and warrant that all content uploaded (including images, credentials, or documents) is lawful, does not infringe third-party rights, and is supported by valid licenses/registrations.

4.3 Patient Stories and Feedback

4.3.1 Patient feedback, reviews, and testimonials (“Critical Content”) are created by Users of the Platform. Mehrmaa Healthcare Pvt. Ltd’s role in such content is restricted to that of an “intermediary” under the Information Technology Act, 2000.

4.3.2 Mehrmaa Healthcare Pvt. Ltd. may collect, display, and process such feedback for all Practitioners.

4.3.3 Practitioners acknowledge that they may be exposed to negative or offensive content and agree that the Platform shall not be liable for business or reputational impacts caused by such content.

4.3.4 Fraudulent, manipulated, or false feedback enabled by Practitioners will result in immediate suspension and potential blacklisting.

4.4 Relevance Algorithm

Mehrmaa Healthcare Pvt. Ltd. employs proprietary algorithms for ranking, search visibility, and relevance of Practitioner profiles. Such algorithms may be modified periodically and cannot be altered for individual Practitioners. The Platform shall not be liable for any impact on Practitioner business due to such algorithmic changes.

4.5 Independent Services

Practitioners acknowledge that each service (listing, teleconsultation, report checking, etc.) confers only limited rights specific to that service and does not extend to any other functionality or privilege.

4.6 Sponsored Listings and Advertisements

Mehrmaa Healthcare Pvt. Ltd. reserves the right to display sponsored ads and promotional listings. Practitioners understand that these are marked as “Sponsored” and the Platform does not guarantee accuracy of claims therein.

4.7 Appointment and Call Facility

4.7.1 Any telephony or booking feature provided is intended strictly for appointment scheduling and administrative coordination. It shall not be used for consultations or emergency care.

4.7.2 Practitioners acknowledge that the Platform shall not be liable for patient feedback, comments, or reviews published in relation to their services.

4.8 Practitioner Undertakings

4.8.1 The Practitioner affirms that they are duly qualified, licensed, and registered under applicable law to provide medical or healthcare services.

4.8.2 The Practitioner shall maintain updated licenses and comply with all applicable regulations, including the National Medical Commission Act, 2019 and relevant State Council rules.

4.8.3 Practitioners shall not provide unlawful, unlicensed, or unethical consultations. Mehrmaa Healthcare Pvt. Ltd. bears no liability for regulatory breaches committed by Practitioners.

4.9 Marketing and Promotion

Practitioners agree that Mehrmaa Healthcare Pvt. Ltd. may use their name, profile, qualifications, logo, or limited content for promotional and marketing purposes, subject to reasonable prior notice.

4.10 Limitation of Liability (Practitioner-specific)

Mehrmaa Healthcare and its affiliates shall not be liable for:

  • The accuracy or completeness of information provided by Practitioners.
  • Outcomes of consultations or treatment provided by Practitioners.
  • Loss of patients, revenue, or goodwill arising from negative reviews, ranking algorithms, or suspension of accounts.

4.11 Termination (Practitioners)

Mehrmaa Healthcare may suspend or terminate a Practitioner’s account if:

  • There is breach of these Terms.
  • Fraudulent, false, or misleading information is found on the Practitioner’s profile.
  • The Practitioner is reported by patients, regulators, or authorities for misconduct.

Upon termination, the Practitioner will lose access to all account-related data.

At Mehrmaa Healthcare Pvt. Ltd. , your trust is paramount, and we endeavor to provide clear and fair refund policies:

  • No refunds once a consultation (online, telephonic, or video) is completed.If a technical failure occurs on our side, you may reschedule at your convenience.
  • Report Checking / Health Assessments Fees are non-refundable once the service has begun.
  • Appointments can be rescheduled at no extra cost.
  • Rescheduling must be requested at least 2 hours before the scheduled consultation.
  • In case of a technical failure from our side, the appointment will be rescheduled at your convenience.
  • If a healthcare professional cancels due to unforeseen reasons, you will be offered a free reschedule.
